lost promissory note

help needed,please
the co that was holding my real estate note is no longer in business. no one knows the whereabouts of any paperwork and the closer is now deceased. what can I do to get my notes back? or how can I get the buyers to re sign them without making them nervous?thank you

Maybe actual notes unneeded

If your notes were for RE loans and secured by mortgages or deeds of trust, those notes’ terms would be fully and completely spell out in those docs so those recorded (?) liens would be all the proof needed to collect on their notes.

And if your collection co was a state licensed escrow co then maybe that state licensing office can help you find the original notes.

Lost note

Generally when a lender loses a note they can purchase a “lost instrument bond” in lieu of presenting the original, particularly if they have a valid copy. So not having an original is not fatal.
